1. Acceptance of Terms
By accessing or using OverlandPlans ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
OverlandPlans is operated as a Doing Business As (DBA) under its owner. References to "we," "us," or "our" refer to OverlandPlans.
2. Description of the Service
OverlandPlans is a trip-planning platform designed to help users organize overland, off-road, and outdoor trips, including but not limited to routes and locations, gear and equipment lists, attendees and groups, notes, meals, and trip details. The Service is for planning and informational purposes only.
3. Assumption of Risk (IMPORTANT)
Overlanding, off-roading, and outdoor travel are inherently risky activities. By using OverlandPlans, you acknowledge and agree that:
- All routes, locations, and trip data are informational only.
- Conditions such as weather, terrain, closures, and hazards can change at any time.
- You are solely responsible for verifying routes, conditions, legality, and safety.
- You assume all risks related to travel, vehicle operation, equipment use, injury, damage, or loss.
OverlandPlans is not responsible for accidents, injuries, deaths, vehicle damage, equipment loss, or any other harm.
4. No Professional or Navigation Advice
OverlandPlans does not provide navigation guarantees, safety certifications, mechanical advice, legal access confirmation, emergency services, or rescue services. You should always use proper navigation tools, check local laws and land access rules, and travel prepared and responsibly.
5. User Accounts
To access certain features, you must create an account.
You agree to:
- Provide accurate information.
- Keep your login credentials secure.
- Be responsible for all activity under your account.
We reserve the right to suspend or terminate accounts for violations of these Terms.
6. Subscriptions, Free Trials & Billing
OverlandPlans offers paid subscription plans, which may include monthly or annual billing and free trial periods (if offered at the time of signup).
Free Trials
- If a free trial is offered, you will not be charged until the trial ends.
- At the end of the trial, your selected payment method will be charged automatically unless you cancel before the trial ends.
Billing
- Payments are processed by Stripe.
- Subscription fees are billed in advance.
- You authorize recurring charges based on your selected plan.
Cancellations
- You may cancel your subscription at any time.
- Cancellation takes effect at the end of the current billing period.
- No refunds are provided for partial billing periods unless required by law.
7. User Content
You retain ownership of content you create (trip plans, notes, gear lists, etc.). By using the Service, you grant OverlandPlans a non-exclusive, limited license to store, process, and display your content solely for providing the Service.
You are responsible for ensuring your content does not violate laws, infringe on others' rights, and is appropriate and lawful.
8. Acceptable Use
You agree not to:
- Misuse the Service.
- Attempt unauthorized access.
- Upload malicious code.
- Harass or abuse other users.
- Use the Service for illegal purposes.
9. Service Availability
We strive for reliability but do not guarantee uninterrupted access. OverlandPlans may modify features, temporarily suspend access for maintenance, or discontinue parts of the Service at any time.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." We make no warranties regarding accuracy of data, availability, fitness for a particular purpose, or reliability of routes or trip information.
11. Limitation of Liability
To the fullest extent permitted by law, OverlandPlans shall not be liable for personal injury or death, property or vehicle damage, lost data, lost profits, or any indirect or consequential damages. Your sole remedy for dissatisfaction is to stop using the Service.
12. Indemnification
You agree to indemnify and hold harmless OverlandPlans from any claims arising from your use of the Service, your content, or your trips or activities planned using the Service.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which OverlandPlans operates, without regard to conflict-of-law principles.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
